Won&#8217;t Hear Seatbelt Appeal"},"content":{"rendered":"<p><img loading=\"lazy\" decoding=\"async\" id=\"image131\" style=\"width: 115px; height: 154px\" height=\"154\" alt=\"seatbelt.jpg\" src=\"https:\/\/www.cavanagh.ca\/blog\/wp-content\/uploads\/2006\/03\/seatbelt-150x150.jpg\" width=\"115\" \/>The Supreme Court of Canada today refused leave to appeal the Court of Appeal&#8217;s decision in <em><a href=\"http:\/\/www.ontariocourts.on.ca\/decisions\/OntarioCourtsSearch_VOpenFile.cfm?serverFilePath=d%3A%5Cusers%5Contario%20courts%5Cwww%5Cdecisions%5C2005%5Cseptember%5CC40232%2Ehtm\"><strong>Snushall v. Fulsang<\/strong><\/a><\/em>. That was the ruling given last September, in which the Court of Appeal held that contributory negligence for failure to wear a seatbelt should fall in a range of 0 to 25 per cent. Only when use of a seatbelt would have prevented substantially <em>all<\/em> of the plaintiff&#8217;s injuries should the apportionment of contributory negligence reach the 25% level.<\/p>\n<p>So, the <em>Snushall <\/em>rule is now well-entrenched as the law in Ontario.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>The Supreme Court of Canada today refused leave to appeal the Court of Appeal&#8217;s decision in Snushall v.
