{"id":498,"date":"2009-03-26T16:43:57","date_gmt":"2009-03-26T21:43:57","guid":{"rendered":"http:\/\/www.cavanaghwilliams.com\/blawg\/?p=498"},"modified":"2009-03-26T16:43:57","modified_gmt":"2009-03-26T21:43:57","slug":"what-information-must-be-provided-at-discovery-regarding-surveillance","status":"publish","type":"post","link":"https:\/\/www.cavanagh.ca\/blog\/?p=498","title":{"rendered":"What Information Must Be Provided at Discovery, Regarding Surveillance?"},"content":{"rendered":"<p>Mr. Justice John Cavarzan has provided some clarification about a small point that not-infrequently comes up in personal injury litigation: what questions must the defendant answer about surveillance that has been undertaken on the plaintiff?<\/p>\n<p>The case is <em><a href=\"http:\/\/www.canlii.com\/en\/on\/onsc\/doc\/2009\/2009canlii12116\/2009canlii12116.pdf\" target=\"_blank\"><strong>Marchese v. Knowles<\/strong><\/a><\/em>. In a nutshell, this\u00a0the information that\u00a0Cavarzan J. said\u00a0must be given:<\/p>\n<ul>\n<li>the names and addresses of the investigators who did the surveillance;<\/li>\n<li>dates, times and precise locations of the surveillance;<\/li>\n<li>particulars of the observations made; and<\/li>\n<li>particulars contained in log notes, if any.<\/li>\n<\/ul>\n<p>His Honour then went on to deal with documents that need not be produced and questions that need not be answered:<\/p>\n<ul>\n<li>The engagement letter sent to &#8220;the surveillance people&#8221;, need not be produced. Justice Cavarzan noted that this document would be privileged and that surveillance investigators testify as ordinary witnesses, not as experts. Accordingly, a letter engaging their services is not a &#8220;finding&#8221; within the meaning of Rule 31.06(3);<\/li>\n<li>How often the insurer had engaged &#8220;these people&#8221; to undertake surveillance in the past is an irrelevant question and need not be answered.<\/li>\n<li>No resumes of the investigators need be provided, except to the extent that the resumes contain the names and addresses of the investigators, which information must be given.<\/li>\n<\/ul>\n","protected":false},"excerpt":{"rendered":"<p>Mr. Justice John Cavarzan has provided some clarification about a small point that not-infrequently comes up in personal injury litigation: what questions must the defendant answer about surveillance that has been undertaken on the plaintiff?
